These Terms of Use ("Terms") govern your access to and use of towersealants.com (the "Site"), operated by Tower Sealants, a brand of M-D Building Products, with offices at 2095 Memorial Park Dr., Gainesville, GA 30504, USA ("Tower Sealants," "we," "us," or "our").

By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

By accessing, browsing, or otherwise using the Site, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, Cookie Policy, and Disclaimer.

The Site is intended for use by professional painters, contractors, dealers, distributors, and adults aged 18 and over. By using the Site, you represent that you meet these requirements.

Product specifications, technical data, performance claims, application instructions, and images on the Site are provided for general guidance and may change without notice. Always read and follow the printed instructions and safety information on the product label, and refer to the current Technical Data Sheet (TDS) and Safety Data Sheet (SDS) for the product you are using. Where information on the Site differs from the product label or current TDS/SDS, the product label and current TDS/SDS prevail.

Online Store

Purchases made through our online store at shop.towersealants.com are governed by separate Store Terms of Sale, Shipping, and Returns policies published on that site. These Terms of Use govern only your use of towersealants.com.

User Submissions

If you submit information, files, photographs, or other content to us through a form, email, or any other channel ("Submissions"), you grant Tower Sealants a worldwide, royalty-free, perpetual, non-exclusive licence to use, reproduce, modify, and distribute that Submission for the purpose of providing support, improving our products and services, and (where you have given consent or where you have published the Submission publicly) for marketing purposes.

You represent that you own or have the right to grant this licence and that your Submission does not violate any third-party rights.

TO THE FULLEST EXTENT PERMITTED BY LAW, TOWER SEALANTS, M-D BUILDING PRODUCTS, AND THEIR AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100).

Indemnification

You agree to indemnify, defend, and hold harmless Tower Sealants, M-D Building Products, and their affiliates, officers, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of or related to your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

Governing Law

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Dispute Resolution

Any dispute arising out of or related to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Hall County, Georgia, USA, and you consent to the personal jurisdiction of those courts.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

We may update these Terms from time to time. The "Effective" date at the top will reflect the most recent version. Your continued use of the Site after a change means you accept the updated Terms.
